NEB update to Federal Court decision

The Federal Court of Appeal decision of August 30th 2018 has quashed the Order in Council approving the Trans Mountain Expansion project, and nullified the Certificate issued by the NEB for the Project. In the absence of a Certificate, the NEB expects that Trans Mountain will safely cease all construction activity in a manner that minimizes environmental impact. The Board will actively monitor Trans Mountain’s actions, and take any necessary steps to ensure Trans Mountain safely and securely halts construction.
Ongoing processes directly related to the Trans Mountain Expansion project, including consideration of condition compliance filings, Right of Entry applications and detailed route hearing processes, will cease.
The NEB remains committed to building meaningful relationships with Indigenous Communities, and to implementing the Terms of Reference for the Trans Mountain Indigenous Advisory Monitoring Committee (IAMC). The scope of the IAMC’s work includes collaboration and monitoring of Trans Mountain’s existing pipeline system.
The NEB will continue to provide regulatory oversight of the existing Trans Mountain pipeline system, with a focus on ensuring safe operation of those facilities.
