Subject: Regulations Amending Certain Canadian Energy Regulator Regulations (Miscellaneous Program) SOR/2022-199 – Now in Force

This email is to notify you that the Regulations Amending Certain Canadian Energy Regulator Regulations (Miscellaneous Program) [the Amending Regulations] and the Regulatory Impact Analysis Statement were published in the Canada Gazette, Part II on 12 October 2022 and are now in force.

The Amending Regulations make non-substantive amendments to three regulations to align with the changes introduced by the Canadian Energy Regulator Act (CER Act) and to correct minor errors:

  • Administrative Monetary Penalties Regulations (National Energy Board) SOR/2013-138 (AMP Regulations);
  • Canadian Energy Regulator Onshore Pipeline Regulations SOR/99-294 (OPR); and,
  • International and Interprovincial Power Line Damage Prevention Regulations – Obligations of Holders of Permits and Certificates SOR/2020-49 (IPLDPRs-Obligations).

The amendments to the AMP Regulations are made to align names, terms, and section numbers with the CER Act which came into force on 28 August 2019 and replaced the National Energy Board Act (NEB Act). Miscellaneous amendments are also being made to the OPR and to the IPLDPRs-Obligations to correct minor errors. The French version of the OPR requires corrections to a grammatical error raised by the Standing Joint Committee on the Scrutiny of Regulations. The IPLDPR-Obligations requires a correction to a typo in the Interpretation section.
