Funding to Support the Participation of Indigenous Peoples in the Rules Review

Are you an Indigenous community, partner, organization, or representative of an Indigenous community with a direct interest in the Canada Energy Regulator’s (CER) Rules of Practice and Procedure Review (Rules Review)?

If yes, you can apply [PDF 313 KB] before October 9, 2024 to receive a $6,000 grant to assist with providing a written submission by December 9, 2024 and to participate in related activities (e.g., optional information session or meeting with CER staff).

What is the Rules of Practice and Procedure Review?

The National Energy Board Rules of Practice and Procedure, 1995 (the Rules) govern the procedures to be followed during written or oral hearings of the Commission of the CER, previously the National Energy Board. Among other things, the Rules set out how applications will be assessed, how to submit a complaint during a public hearing, and the overall conduct of public hearings. The Rules are made by the Commission under the Canadian Energy Regulator Act (CER Act) (section 35).

A comprehensive update to the Rules is needed to align with the CER Act, which came into force in 2019. The update will reflect the CER’s new governance structure, and formalize the practices, processes, and terminology which have evolved since the Rules were first in effect. Areas of Focus

In broad terms, the objective of the Rules Review is to deliver regulations that:

  • align with the CER Act, including the objectives outlined in the Act’s preamble, such as the commitment to Reconciliation;
  • enhance competitiveness through predictable and timely processes; and
  • modernize practices and procedures.

The CER is seeking feedback from Indigenous Peoples and Indigenous communities, particularly those who have recently participated in a CER hearing, to inform the Rules Review.

An Indigenous community, partner, organization, or representative of a community with a direct interest in the Rules of Practice and Procedure Review.

What you need to know before you apply:

The deadline to apply for the $6,000 grant is October 9, 2024. Successful applicants will receive a grant letter to sign and direct deposit form to complete. Once the grant letter is signed by both parties and direct deposit has been setup, the grant will be paid and reported as part of Proactive Disclosure of Grants and Contributions.

The total amount allocated for this funding opportunity is $300,000. In the event that the number of applications exceeds this amount, priority may be given to those who have participated previously in a CER regulatory process.

The issuance of the grant is conditional on the recipient providing a written submission with feedback about the Rules Review to the CER.
