2025–26 Annual Report of the Commission of the Canada Energy Regulator - Commission Decisions and Recommendations

During 2025-26, the Commission issued 605 decisions related to infrastructure, tolls and tariffs, export licences and orders, leave to open orders, and other matters, as summarized below in Table 2. Compliance related decisions are reported separately in Appendices E-G.

Table 2: Commission Decisions and Recommendations, 2025-26

The total of 605 decisions compares to 581 issued in 2024–25. Notable year-over-year changes include:

• Infrastructure decisions increased from 43 to 58;
• Tolls and tariffs decisions increased from 18 to 29;
• Export decisions remained essentially unchanged at 486, compared to 487 in 2024-25;
• Four of the export applications were for long-term export orders, a type of application not received in recent years;
• Leave to Open Orders decreased from 17 to 11; and
• Other decisions – such as variances, time extensions, and compensation matters - increased from 16 to 21.

Given the technical and administrative nature, Exploration and Production decisions under COGOA are delegated to the Chief Conservation Officer and are not included in the total number of Commission decisions. The number of these decisions increased significantly from 25 in 2024-25 to 320, primarily due to Imperial Oil Resources N.W.T. Limited's notice to the CER of the permanent cessation of oil production at its Norman Wells Facility, scheduled for August 2026.

In addition to the decisions captured above, the Commission issued interlocutory and interim decisions throughout its proceedings, including decisions on confidentiality requests, notices of motion, and other procedural matters. These decisions are not captured in the totals reported here.
