Regulations Amending the National Energy Board Act Part VI (Oil and Gas) Regulations published in the Canada Gazette, Part II

On 23 June 2015, the Government of Canada’s Economic Action Plan 2015 Act received Royal Assent. It amended the National Energy Board Act (NEB Act) to allow for the issuance of natural gas export licences for a term not exceeding 40 years.

On 29 June 2015, the National Energy Board (NEB or Board) issued a notice seeking public input on proposed amendments to the National Energy Board Part VI (Oil and Gas) Regulations (Part VI Regulations). The amendments included a proposed definition of “natural gas” that was required to implement the aforementioned changes to the NEB Act. The Board received 5 letters of comment regarding the proposed regulatory amendments. The letters are available on the NEB’s website (www.neb-one.gc.ca) under “Acts and Regulations”.

The Regulations Amending the National Energy Board Act Part VI (Oil and Gas) Regulations (Regulations) were made on 31 July 2015 and are now in effect. The Regulations were published in the Canada Gazette, Part II on 12 August 2015 and can be reviewed on the Canada Gazette website (www.canadagazette.gc.ca).

The Board is currently developing guidance for parties who may be interested in applying for a natural gas export licence for a term not exceeding 40 years. Such guidance will be posted on the NEB website when finalised.
