Important update on regulatory oversight of the Trans Mountain Expansion project
Detailed route hearings have been cancelled and the National Energy Board (NEB) has notified all participants. On August 30, 2018, the Federal Court of Appeal (FCA) released a decision that quashed the Order in Council approving the Trans Mountain Expansion project, and nullified the Certificate issued by the NEB for the Project. In the absence of the Certificate, the NEB expects that Trans Mountain will safely cease all construction activity in a manner that minimizes environmental impact. The NEB will actively monitor Trans Mountain’s actions, and take any necessary steps to ensure Trans Mountain safely and securely halts construction. As a result of the FCA’s decision, all ongoing NEB processes directly related to the Trans Mountain Expansion project, including consideration of condition compliance filings, Right of Entry applications and detailed route hearing processes, have ceased.

When the Government of Canada approved the Trans Mountain Expansion project in 2016, it approved a 150 metre-wide corridor. The detailed route process was well underway when the August 30, 2018 FCA ruling triggered work to cease on these files.
