Resources for Landowners

• Land Matters Guide: When you hear about a project being proposed on your land or on land in which you have an interest, you may have questions and concerns. The CER has produced this Land Matters Guide to help.
• Land Matters Advisory Service: If you have questions about land matters with respect to CER-regulated energy projects and processes: 1-800-899-1265 or  LMAS.SCQF@cer-rec.gc.ca.
• Land Matters Group – The CER’s LMG engages Canadians on land matters allowing participants to share insight and advice on protecting landowner rights and interests. Sign Up for Email Updates or to Share Information.
• Alternative dispute resolution: Any time during the life of a project, if you are unable to resolve concerns directly with the company, you can email: ADR-RED@cer-rec.gc.ca to ask a specialist to work with you and the company to find solutions.
• Complaint Resolution: If you are unable to resolve an issue with a CER-regulated company, facility, or activity on lands you use or own, you can send us a completed: Complaint form [PDF 190 KB]

CER’s Regulatory Oversight

• Pipeline Profiles: Learn more about the NGTL pipeline system as a whole via the CER’s Pipeline Profiles. The NGTL pipeline system profile primarily focus on economics and the financial performance of regulated oil and natural gas pipelines. It will soon include a new Safety and Environment section to address the public interest in environmental and safety performance data.
• CER Acts, Regulations, Rules, and Guidance Notes: The mandate, responsibilities and powers of the CER are established by a number of Acts and Regulations. Links are provided to each of these documents, as well as supporting guidance documents.
• Lifecycle Approach to Regulation: The CER’s regulatory oversight spans the entire life of a project.

Key documents related to the CER’s Review of the 2021 NGTL System Expansion Project (NGTL 2021)

• 2021 NGTL System Expansion Project Application [Filing A92619]: All documents pertaining to NGTL’s application that was filed with the Regulator on June 20, 2018.
• Canada Energy Regulator Recommendation Report on 2021 NGTL System Expansion Project [Document C04761-1]: Following its review of the project, the Commission submitted a recommendation report to the Minister of Natural Resources. This report contains the Commission’s recommendations along the reasons for its decisions.
• The Traditional Knowledge Report (Appendix K of the Environmental and Socio-economic Assessment) [Filing A96320]: This provides a detailed synopsis of the studies conducted, Indigenous Communities and Groups involved as well as issues and concerns that were raised.
• Crown Consultation and Accommodation Report for NGTL 2021 System Expansion Project:  This report, completed by Major Project Management Office (Natural Resources Canada), describes the outcome of the Crown’s consultation process with potentially impacted Indigenous Communities with respect to the project.
• Order-in-Council for NGTL 2021 and Amended Conditions: The Governor-in-Council, on recommendation of the Minister of Natural Resources, issued an Order-in-Council outlining condition amendments and direction for the CER to issue a Certificate for the project.
• Certificate of Public Convenience and Necessity, GC129 [Document C09098-3]: This Certificate means the project is approved and can move forward. It was issued pursuant to Section 52 of CER Act, along with Order XG-001-2020 [Filing C09385]as amended, are the primary regulatory instruments specific to the 2021 NGTL Project. Other regulatory requirements, federal, provincial and municipal, must also be met.

Detailed Route and Construction

• Approval of Plan, Profile, and Book of Reference [Filing C11085]: Once a project is approved, the company files documents with the CER called the plan, profile, and book of reference or PPBoR. These documents contain details on the route of the pipeline.
• Compliance Filings for Certificate Conditions: Certificates issued by the CER contain the conditions that must be met by the company.
• Construction Schedule [Filing C10858]: This provides an overview of where the company is at with respect to construction. The CER’s compliance and project managers, inspectors, and expert staff oversee construction activities to make sure people, the environment and property are protected.
• Commitment Tracking Table [Filing C11138]: NGTL was required to file its Commitment Tracking Table 30 days prior to construction, and it is now filed with the CER on a monthly basis until the project begins operating. Once operation begins it is to be submitted to the CER every four months for the next five years
