When a risk is identified during the assessment of an application, the Commission may impose project-specific conditions to reduce risks, prevent harm, promote safety, and protect the environment.
Commission project decisions will typically impose conditions. These conditions can relate to activities that occur during construction but may extend into the operation phase of the facility, such as undertaking caribou habitat restoration, post-construction monitoring reporting or reporting on engagement with Indigenous Peoples. Conditions can require submission of documents for filing, in which case the company submits their filing, which will be evaluated by CER staff. Conditions can require submission of documents for Commission approval, in which case the Commission assesses and either approves or rejects the filing through a regulatory decision.
Companies are accountable for constructing and operating facilities commensurate with Commission authorizations, inclusive of the imposed conditions. Through construction and into operations if a company needs to make a change, they will update the CER or make a request of the Commission.
The CER received 413 post approval condition filings for the reporting year 2025-26 and the Commission made over 50 post approval decisions. These decisions related to 23 approvals of condition filings, 15 timing relief requests and 13 other decisions related to matters such as gathering information, providing direction or responding to requests.
