The Canada Energy Regulator (CER) is an independent federal agency responsible for regulating pipelines, energy development and trade in the Canadian public interest. Under the CER Act and its regulations, the CER promotes safety and security, environmental protection, and efficient energy infrastructure markets.
The CER regulates the export of crude oil and refined petroleum products, natural gas, natural gas liquids and electricity from Canada. Under the CER Act, export licences, permits or orders are required to export these commodities.
Companies holding export licenses, permits and orders are required, by the National Energy Board Export and Import Reporting Regulations (Reporting Regulations), to file monthly reports on their activities to the CER by a specific due date. The timing of the filings is prescribed by the Reporting Regulations or by the conditions of a company’s export order. The Reporting Regulations also clearly outline the information requirements to be filed each month. Compliance with the Reporting Regulations is mandatory, and the CER expects companies to file reports in a correct and timely manner on or before the due date.
Companies are reminded to file their reports through the Commodity Tracking System (CTS). For information about filing reports using CTS, please see the CTS Frequently Asked Questions. Should a company fail to file its report by the prescribed due date, CTS will automatically track the non-compliance.
Late filing of reports and failure to report are contraventions of the Reporting Regulations and a company’s export order, if applicable. If companies fail to report the required information, or report past the due date, the CER will follow up and may take enforcement measures to obtain future compliance. This letter serves as a reminder to all companies to file the required information on time. Reporting of this export data is essential to fulfilling the CER’s mandate of providing timely and accurate data to Canadians and other government departments.
