is employed by Vantage Pipeline Canada ULC, or is a person conducting an excavation or construction on or near a facility located at Spread D, Vantage Pipeline Project.

On 18 October 2013, the undersigned National Energy Board inspection officer conducted an inspection of Spread D, Vantage Pipeline Project.

The inspection officer has noted the following:

The inspection officer has noted the following: During an inspection of the Project on 15 to 18 October 2013, the Vantage Pipeline Construction Inspection Program as submitted and approved in accordance to Condition 27 of Certificate OC-059 was not fully implemented. Specifically, a) the Bending Inspector did not have adequate qualifications, training and tools to perform his duties, b) the Welding Inspector at the Tie-In crew did not have the tools necessary to perform his duties, and c) the Lowering-in Inspector was not aware that one of his responsibilities is to inspect sleeve coating.Based on the above mention, the inspection officer has reasonable grounds to believe that a hazard to the safety or security of the public, or employees of a company or a detriment to property or the environment is being or will be caused by the construction, operation, maintenance or abandonment of the pipeline.

Based on the above mention, the inspection officer has reasonable grounds to believe that a hazard to the safety or security of the public, or employees of a company or a detriment to property or the environment is being or will be caused by the construction, operation, maintenance or abandonment of the pipeline.

Therefore, Vantage Pipeline ULC is HEREBY ORDERED, pursuant to section 51.1 of the National Energy Board Act, to

 X take measures specified below for guarding the safety or security of the public or employees or protecting property or the environment
  Stop work
  Immediately
   no later than

Specified Measures:

  1. Verify that all Inspectors on-site have: a clear understanding of their roles and responsibilities; adequate qualifications and training; and the tools to perform their duties.
  2. Ensure compliance to the Vantage Pipeline Construction Inspection Program Revision 0 dated July 2012 and approved by the Board on 30 August 2012, including filling the position of Assistant Chief Inspector by Tuesday 22 October 2013.
  3. Ensure that each crew without a qualified Inspector on-site shall be shut down until an Inspector meeting the requirements outlined in a) above is assigned to each crew.
  4. Submit written confirmation that a, b, and c above have been completed and provide supporting documentation to the Inspection Officer as soon as it is available.
