On 27 March 2017, Trans Mountain Pipeline ULC (Trans Mountain) applied to under section 21 of the National Energy Board Act (NEB Act) for the Chilliwack BC Hydro Route Realignment (Chilliwack Realignment), a variance to the approved Trans Mountain Expansion Project (TMEP) pipeline corridor in the Certificate of Public Convenience and Necessity OC-064 (Certificate). The Chilliwack Realignment would change the general pipeline corridor and, if approved, would relocate the TMEP within the existing Trans Mountain pipeline right-of-way. The realignment is outside the approved corridor for approximately 1.8 km.
On 26 June 2017, the Board sent a letter to Trans Mountain requiring Trans Mountain to serve a copy of the letter, and its appendices, on all persons consulted by Trans Mountain for the Chilliwack Realignment. It also established a comment period with a deadline for comments from interested persons of 17 July 2017, and for Trans Mountain’s reply by 24 July 2017. (Folder 331131)
Comments were received from the WaterWealth Project (Filing A84982) and the City of Chilliwack (Filing A84975) (City). The City requested an extension, which was granted by the Board (Filing A85196). Additional comments from the City and reply from Trans Mountain were filed respectively on 14 and 21 August 2017. (Filing A85446 and Filing A85579)
On 31 August 2017, the Board issued Hearing Order OH-001-2017 for the Chilliwack Realignment.

List of Issues
The List of Issues will only consider issues that are relevant to the Chilliwack Realignment. The Board will not reconsider items that were already determined during the Trans Mountain Expansion Project hearing.
- The potential environmental and socio-economic effects of the proposed Chilliwack Realignment, as set out in the NEB’s Filing Manual.
- The appropriateness of the general route and land requirements for the proposed Chilliwack Realignment.
- The suitability of the design of the proposed Chilliwack Realignment.
- Potential impacts of the Chilliwack Realignment on Aboriginal interests.
- Potential impacts of the Chilliwack Realignment on landowners and land use.
- Contingency planning for spills, accidents or malfunctions, during construction and operation of the Chilliwack Realignment.
- Safety and security during construction of the proposed Chilliwack Realignment and operation of the Chilliwack Realignment, including emergency response planning and third-party damage prevention.
- The terms and conditions to be included in any approval the Board may issue in relation to the Chilliwack Realignment.
Apply to Participate
To be a participant in a NEB hearing process, you must be directly affected or have relevant information or expertise. You can apply to participate as an intervenor or by letter of comment.
The application to participate process was held from August 31 – September 21, 2017.

A total of $100,000 is available to assist Participants take part in the Chilliwack Realignment. Refer to the Participant Funding Program page for information on deadlines, eligibility, how to apply for funding, and how to submit claims.
