Project Background

On July 20, 2018, Enbridge Pipelines Inc. submitted an application [Filing A93187] for the Line 5 St. Clair River Replacement Project under Section 58 of the NEB Act and section 45.1 of the NEB Onshore Pipeline Regulations (OPR).The proposed project would include decommissioning part of the existing crossing and installing approximately 0.5 km of new pipe. This would replace the existing Line 5 that crosses beneath the St. Clair River in Sarnia, Ontario.

On 14 September 2018, the NEB found the application to be complete. Under subsection 58(4), the Board has 300 days to issue an order or dismiss the Application. By establishing a hearing process, the time limit for the Board to issue an order or dismiss the Application under subsection 58(4) has changed from the non-hearing assessments under Category C (300 days), to 15 months from the date that the Board determined the Application(s) to be complete. The time limit represents the maximum time in which the Board will complete its assessment.

To be a participant in a NEB hearing process, you must be directly affected or have relevant information or expertise. You can apply to participate as an intervenor or by letter of comment.

The application to participate process was held from January 30 – March 6, 2019.

Participant Funding

Participant funding is available to facilitate the participation in this public hearing. A simplified participant funding process has been approved for this hearing to reduce administrative burden. Eligible groups may request up to $40,000, and individuals up to $6,000, to participate in this hearing. If you are interested in being a funding recipient, please complete the Participant Funding Request Form by by February 14, 2019.
